These terms apply to everyone who uses the Bearing website at bearingconsultancy.co.uk and its free online tools, including the Decision Diagnostic and the Organisational Decision Readiness Tool. Bearing Consultancy Ltd ("Bearing", "we", "us") is registered in England and Wales, company number 17389049, registered office 17 Partridge Close, Northampton, NN2 8BL, and is registered with the Information Commissioner's Office (ZC242169).

The short version

  • You can use this site and our online tools freely for yourself and your own organisation.
  • What you read here is general information. It is not professional, legal or safety advice, and it does not replace a risk assessment or the advice you need for your own event or operation.
  • Our tool results are reflective indicators. They are not tests, audits or assurance, and they should never be used to select, rate or judge people.
  • Bearing owns its frameworks, tools, courses and content. You may use them as these terms allow. Please ask before you copy, teach or sell them.
  • Booking a course, buying a licence or commissioning work is covered by separate terms, not by this page.

1. About these terms

  1. Agreeing to them. By using the site you agree to these terms. If you do not agree, please do not use it. If you use the site for an organisation, you confirm that you are allowed to agree to these terms for it.
  2. Other terms. These terms cover the website and the free online tools only. Bookings for courses are covered by our Terms for Training Customers. Bespoke work, in-house courses, licences and research projects are covered by our Terms for Organisations and Clients, and by the proposal or agreement for that work. If a booking or agreement conflicts with these terms, the booking or agreement applies. Our Privacy Notice explains what we do with personal information.
  3. Changes. We may change these terms, the site or the tools at any time. The date and version at the top show when this page was last updated. Using the site after a change means you accept the new terms.

2. What the site is for

  1. General information. The site tells you about Bearing, our frameworks, our courses and our research. We aim to keep it accurate and up to date, but we do not promise that it is complete or current. Dates, prices, course content and availability may change, and the booking confirmation or the agreement for the work is what counts.
  2. Not advice. Nothing on the site is professional, legal, regulatory, medical or safety advice. It does not replace a risk assessment, the advice of your safety advisers, or the requirements that apply to your event, venue or operation, such as health and safety law and the duties under Martyn’s Law. You stay responsible for your own decisions.
  3. Courses and certificates. A course description is not a promise of accreditation, recognition or outcome. Certificates, memberships and qualifications are issued only under the rules for the course and are described in the terms for that course.

3. Our online tools

  1. What the results are. The Decision Diagnostic and the Organisational Decision Readiness Tool are reflective indicators built on research. They are meant to start a conversation and help you choose a place to begin. They are not psychometric tests, audits, assessments of competence or assurance of any kind.
  2. How you may use them. Use a tool for yourself, or for an organisation you work for. Answer honestly and for your own situation. Do not use a result to select, rate, rank, promote, discipline or dismiss anyone, or to decide whether someone is fit for a role.
  3. Your answers. If you use a tool, we keep your answers as the first screen of the tool describes. We may use them, without your name or your organisation’s name, as research data. Read the Privacy Notice for the detail, including what we can and cannot delete once you have submitted answers.
  4. No guarantee. Results depend on the answers you give and on the way we have built each tool, and they will change as we improve it. We do not promise that a result is accurate for you, and we may change or withdraw a tool at any time.
  5. Using the tools properly. Do not try to copy or reverse engineer the scoring, run automated scripts against a tool, submit false or bulk answers, or interfere with how it works.

4. Our intellectual property

  1. What we own. Bearing owns the Making Better Event Decisions Framework (MBED), the Live Situational Judgement Framework (LSJF), the PULSE stages, the Show-Safe suite, the Decision Diagnostic, the Organisational Decision Readiness Tool, the Decision Approach Compass, our courses, toolkits, scenarios, rubrics, text, images and designs, and the Bearing name and logo. These are protected by copyright and other rights. Where we mark a name or item with a copyright symbol or notice, please keep it in place.
  2. What you may do. You may view the site and print or save copies of pages for your own use or for use inside your own organisation. You may share your own tool result, and quote short extracts of our content, as long as you say clearly that the source is Bearing Consultancy Ltd and link to the site.
  3. What you may not do without our written permission. Copy, republish, sell, licence or share our content or tools other than as the clause above allows, teach or train others using our frameworks, courses or materials, build them into another product, service or training programme, put them into an AI tool to train, fine-tune or build a model, collect them by automated means, or use the Bearing name, logo or product names in a way that suggests we run, endorse or are connected with you or your work.
  4. Other people’s names and marks. Names and logos of our partners, venues and other organisations that appear on the site belong to them. They appear to say who we work with, and they do not mean that those organisations own or endorse anything of ours. Nothing on the site means that any university or other institution that one of our directors or associates works with owns, runs or endorses Bearing.
  5. Getting permission. To ask for permission, write to us at the contact address above and say what you want to use, where, and for how long. We may say no, or give permission on conditions or for a fee.

5. What we ask of you

  1. Acceptable use. Do not use the site to break the law, to send anything harmful, to try to get into our systems or anyone else’s, to overload or damage the site, to copy or collect its content by automated means, or to pass off our work as your own.
  2. What you send us. If you send us a message, an enquiry or feedback, you must be entitled to send it, and it must be true. Please do not send confidential, sensitive or commercial secret material through the site forms. Send what we need to reply, and nothing more. You keep your rights in what you send. You give us permission to use it to reply to you, to deal with your enquiry and, if it is feedback about the site or a tool, to improve our work. We do not use your name or your comments as a testimonial without asking you first.
  3. Your details. Where a tool or form asks for your details, please give your own, and keep them accurate. If you use the site for an organisation, make sure you are allowed to give us that organisation’s information.

6. Links and other services

  1. Links. The site may link to other websites, including our partners, our booking platform and our email service. We do not control them, and we are not responsible for their content or how they use your information. Their own terms and privacy notices apply to them.
  2. Linking to us. You may link to our home page or to a public page of the site if the link is fair and legal, and does not suggest that we endorse you. We may ask you to remove a link at any time.
  3. Third party tools. Some parts of the site, such as booking, email sign-up and the online tools, use services run by other companies. Where you use one, its terms apply as well as these.

7. Cookies and your information

  1. Cookies. The site sets no cookies of its own and uses no analytics or marketing cookies. Two services we use can store information on your device when you use them: the spam check on our forms and the Eventbrite booking window. Where we need your agreement for non-essential cookies, we ask for it first and you can change your choice at any time. Our Cookie Policy explains them.
  2. Personal information. We handle personal information as our Privacy Notice describes. Please read it before you use a tool or send us your details.

8. Availability and security

  1. Availability. We try to keep the site and the tools running, but we cannot promise that they will always be available or free of faults. We may suspend or withdraw any part of them without notice, for example for maintenance.
  2. Viruses and safety. We take reasonable care to keep the site free of viruses and harmful code. We cannot guarantee it, so please use your own protection when you use the site or download anything from it.

9. Our responsibility to you

  1. What we cannot exclude. Nothing in these terms limits or excludes our responsibility for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow us to limit. If you are a consumer, nothing here affects your legal rights.
  2. Use of the site is at your own risk. The site and the tools are provided free and “as they are”. Within the law, we are not responsible for any loss that comes from relying on the content of the site or on a tool result, or from a decision taken, or not taken, using them. That includes decisions about safety, staffing, spending, compliance or events.
  3. Business users. If you use the site for a business, we are not responsible for any loss of profit, income, contracts, business, goodwill or data, or for any indirect or consequential loss. Our total responsibility for all claims about the site and the free tools is limited to £100.
  4. Things outside our control. We are not responsible for a failure or delay caused by something outside our reasonable control, including a fault in a service run by another company.

10. General

  1. Ending your use. We may stop you using the site or a tool if you break these terms. Clauses that by their nature should continue, such as those on intellectual property and our responsibility to you, continue after that.
  2. If part of the terms does not work. If a court decides that part of these terms cannot be enforced, the rest still applies. If we do not enforce a right straight away, we can still do so later.
  3. Who can enforce them. These terms are between you and Bearing. Nobody else has a right to enforce them.
  4. Law and courts. These terms and any dispute about them are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring a claim in the courts where you live.
  5. Complaints. If you are unhappy with the site or a tool, tell us at the contact address above and we will look into it. For complaints about how we handle your personal information, see the Privacy Notice.
